windows 8 - win 8.1 can't sleep automatically after hibernating

There have been many post online about win 8.1 not entering sleep mode, my problem however only happens after I wake the device from hibernation (data saved to memory, power off).
laptop: Asus eee PC 1201n (made in 2009) Windows 8.1
Boot machine, sleeps normally.
If I ever hibernate the machine, after it wakes from hibernation it won't automatically sleep ever again(screen-off works automatically, but not sleep). Please note when I say hibernation it's the actual windows "hibernate", and sleep is the actual windows "sleep". Two different power modes.
If I turn off all internet connections, it will automatically sleep again.
If I reboot, it will also automatically sleep again
If I ever hibernate, problem resumes
So something about hibernation causes a network problem which prevents auto-sleeping, and can be fixed by turning off all internet connections.
Solutions attempted: Leaving homegroup and disabling network sharing Disabling IPV6 checking all powercfg requests
Does anyone else have this issue tied up with hibernation?
I have Hybrid sleep active which makes it so the computer sleeps and remains powered on in a low-power state while also creating a hibernation backup file.
If I leave my machine in this state and the power is cut, will the machine automatically resume when the power is restored or will I have to press power?
ie: does it remember that it was in sleep mode when power is supplied again?
It depends on what the BIOS is set to do.
Depending on your computer, the BIOS may have a power setting called something like
Return to power status.
Its normally under the power settings in the BIOS.
